Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE CHANCES OF WINNING. Void where prohibited by law. Subject to all federal, state, province and local laws of the Eligibility Areas (defined below).

Promotion (defined below) begins on May 1, 2024 at 9:00:01 am Hawaiian Standard Time (“HST”) (2 May 2024 at 5:00:01 am Australian Eastern Standard Time (“AEST”)) and ends on May 31, 2024 at 11:59:59 pm HST (1 June 2024 at 7:59 pm AEST) (the "Promotion Period"). Administrator's computer is the official time keeping device for this Promotion.

1. Eligibility: The Hawaiian Airlines 31 Days of Lei Sweepstakes (“Sweepstakes” or the “Promotion”) is open to legal residents of the 50 U.S./D.C., all states and territories (excluding South Australia) within Australia, South Korea, Japan, and New Zealand (“Eligibility Areas”, each an “Eligibility Area”), who are at least eighteen (18) years of age or age of majority as of the date of entry. Employees, officers, and directors of Hawaiian Airlines, Inc. ("Sponsor"), Don Jagoda Associates, Inc. ("Administrator"), and any of their respective parents, affiliates, subsidiaries, franchisees, mandataries, representatives, agents, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, web site providers, web masters, and members of their immediate families (spouses, ex-spouses, de-factor spouses, parents or step-parents, grandparents or step-grandparents, siblings or step-siblings, children or step-children (whether natural or by adoption), uncle, aunt, niece, nephew or first cousin, regardless of where they live) and those living in the same household with them (whether or not related) are not eligible to enter the Promotion. The Promotion is subject to all applicable laws and regulations and is void where prohibited. Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion, subject to consultation with the relevant legislative authorities.

2. Sponsor/Administrator: The Sponsor is Hawaiian Airlines, Inc., 3375 Koapaka Street, Ste. G-350, Honolulu, HI 96819, United States (telephone: 1 (877) 426-4537) (ABN: 27 130 481 971). The Administrator is Don Jagoda Associates, 100 Marcus Drive, Melville, NY 11747, United States.

In Australia (excluding South Australia), the Promotion is authorized under ACT Trade Promotion Lottery Permit No. TP 24/00852, NSW Trade Promotion Authority No. TP/03446.

3. How to Enter: To enter the Sweepstakes and receive one (1) entry (the “Entry”) into the random drawing, as described in rule 4, you must, during the Promotion Period:

1. visit www.hawaiianairlines.com/31DaysofLeiSweepstakes (the “Site”) to complete the registration form, following the on-screen instructions; and
2. consent to receiving future marketing communications from Hawaiian Airlines (by checking the relevant box in the registration form),

(collectively, “Entry Conditions”).

Both Entry Conditions must be satisfied in order to receive an Entry. Information required in the registration form includes the name, email, country and postcode of each Entrant.

There will be four (4) weekly Entry Periods (each, “Entry Period”), as shown in the chart below:

Limit one (1) Entry per person throughout the Promotion Period. Eligible non-winning Entries will be automatically carried forward to subsequent Entry Periods. If more than one Entry per person is received during the Promotion Period, only the first Entry will be valid, and later Entries will be invalid and therefore will not enter into the random drawing.

The person registering will be deemed the entrant (the “Entrant”). In the event of a dispute as to the identity of an Entrant, the authorized account holder of the email address used to enter will be deemed to be the Entrant. “Authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

Any Entry not in compliance with these Official Rules may be disqualified as determined by Sponsor in its sole discretion. Entrants are subject to disqualification, if Sponsor or Administrator discovers that multiple email addresses are used by the same person to submit multiple Entries.

As applicable, normal Internet/phone access and usage/data charges imposed by Entrants’ online/mobile service will apply and are payable by the Entrant.

Entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method are ineligible and would be disqualified.  Sponsor reserves the right to disqualify any individual and/or Entries using such methods. 

By entering this Sweepstakes, Entrants hereby authorize Sponsor and/or Administrator to use Entrants’ email addresses or other contact information, and the Entrants’ HawaiianMiles account number solely for the purpose of delivering the Prize.

4. Sweepstakes Random Drawing: At 9:00:00 a.m. HST of the first Wednesday (5:00 a.m. AEST of the first Thursday) following the end of each Entry Period, five (5) winners (one (1) per Eligibility Area) will be selected in a random drawing before an independent scrutineer via www.randomdraws.com/au/. The drawings will be randomly selected from all eligible Entries received throughout the relevant Entry Period and (where applicable) all eligible non-winning Entries rolled over from the previous Entry Period(s). The drawings will be conducted by the Administrator, an independent judging organization whose decisions are final on all matters relating to the Sweepstakes. Odds of winning depend upon the number of eligible Entries received during the Promotion Period.

5. Winner Publication, Notification and Prize Claims:  Within 30 days of the drawing of each Entry Period, the names and postcodes of winners will be published on www.hawaiianairlines.com/31DaysofLeiSweepstakes for 28 days.  The names of winners will also be published in the newspaper the Australian.

Within 7 days of the drawing of each Entry Period, all potential winners will be notified directly by email. The potential winners will be sent via email a Declaration of Compliance, Liability & Publicity Release (where legal) (“Declaration”).

In order to claim his/her/their Prize, each potential winner will be required to provide the following via email within fourteen (14) days of being notified:

1. the completed and signed Declaration; and
2. the account name of his/her/their HawaiianMiles Account.

With respect to (b) above, as the Sponsor will deposit the Prize directly into each winner’s HawaiianMiles account, each potential winner must establish a Hawaiian Airlines HawaiianMiles account (if he or she does not already have such an account). HawaiianMiles accounts are free to open, and the account and use of the HawaiianMiles are subject to the program’s terms and conditions: www.HawaiianAirlines.com/legal/hawaiianmiles-terms-and-conditions. The Prize shall be used and will expire pursuant to Hawaiian Airlines’ program terms and conditions, which are subject to change from time to time and these changes would be published on Hawaiian Airlines’ website.

If any potential winner fails to return the Declaration and/or the HawaiianMiles Account details within the required fourteen (14) day time period (“Claim Period"), or any prize notification email is returned undeliverable, or in the event that a potential winner is disqualified for any reason, Sponsor will award the applicable Prize to an alternate winner selected by a random drawing from among all remaining eligible Entries received by the end of the Entry Period. That re-draw will take place within seven (7) days following the end of the Claim Period.  The winner will be selected in a random drawing before an independent scrutineer via www.randomdraws.com/au/. The re-draw will be conducted by the Administrator, an independent judging organization whose decisions are final on all matters relating to the Sweepstakes

Potential winners are subject to verification by Sponsor and/or Administrator, whose decisions are final and BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. A potential winner cannot claim the Prize unless and until the winner's eligibility has been verified and winner has been notified that verification is complete.

The list of winners will be available within seven (7) days of the determination of the winners, if requested.  Such request can be made by sending an email to: Winners@dja.com with “WINNERS” and “Hawaiian Airlines 31 Days of Lei Sweepstakes” as the subject line.

6. Prize: Twenty (20) winners will be selected throughout the four (4) Entry Periods (four (4) winners from each Eligibility Area). During each Entry Period, one (1) winner will be selected from each Eligibility Area, with five (5) winners in total in each Entry Period. Each winner will be awarded 200,000 HawaiianMiles (conditions apply) (“Prize”). The Approximate Retail Value (“ARV”) of each Prize is USD $6,000 (AUD $9,355, subject to currency fluctuation) (excluding any taxes or fees). The Prize will be deposited directly into each winner’s HawaiianMiles account within 28 days after the draw of each Entry Period.

Conditions Apply: Limit one (1) Prize per person. Prize cannot be substituted, assigned, transferred, or redeemed for cash. Winners are responsible for any loss of Prize after it has been delivered. Sponsor will not replace any lost or stolen Prize.

Any and all applicable federal, state, provincial and local taxes and all fees and expenses related to acceptance and use of Prize not specifically stated herein are the sole responsibility of the Prize winner. Prize winners from the USA will be issued a 1099 tax form for the actual value of the Prize.

7. General Conditions: To the fullest extent permitted by law, Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion.

In the event of cancellation, any remaining Prizes will be awarded via random drawing from among all eligible Entries received prior to cancellation (where possible, evenly distributed among all Eligibility Areas). Sponsor, Administrator, and their agencies are not responsible for lost, late, incomplete, damaged, illegible, postage-due, stolen or misdirected Entries; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user's computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Sponsor's or Administrator's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, and/or the legitimate operation of the Promotion; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Promotion is not capable of running as planned, Sponsor may, in its sole discretion (subject to approval from the relevant regulators), void any suspect Entries and (a) modify the Promotion or suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; and/or (b) cancel the Promotion and award the remaining Prizes via random drawing from among all eligible Entries received  prior to cancellation (where possible, evenly distributed among all Eligibility Areas).

8. Release and Limitations of Liability: By participating in this Promotion, Entrants agree that Sponsor and Administrator, and each of their respective parents, affiliates, subsidiaries, franchisees, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, website providers, web masters, and their respective officers, directors, employees, representatives and agents (collectively, the "Released Parties") are not responsible for, and Entrants agree to release and hold harmless the Released Parties against, any claim or cause of action arising out of Entrants’ participation in this Promotion or receipt or use of any information, including but not limited to: (a) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, unavailability or disconnections in the Internet, phone lines or network, hardware or software, or any computer systems, Internet service provider or mail service; (c) unauthorized human intervention in any part of the entry process or the Promotion; (d) technical or human error which may occur in the administration of the Promotion or the processing of Entries; (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Promotion or receipt or use or misuse of the Prizes; (f) any Force Majeure Events (as defined below). 

By participating in this Promotion, unless prohibited by law, Entrants agrees to waive any right to claim ambiguity with respect to these Official Rules.

Acceptance of Prize constitutes permission to use winners’ names, photographs, and likenesses for publicity purposes solely in connection with the Promotion without further compensation except where prohibited by law. Under no circumstances should Entrants give their credit card account number, or any information regarding their account, over the phone or mail in connection with this Sweepstakes.

BY PARTICIPATING IN THIS PROMOTION, ENTRANTS AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY THE LAW OF THE RELEVANT ELIGIBILITY AREA, THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND AGREE TO HOLD HARMLESS THE RELEASED PARTIES AGAINST, ANY CLAIMS, CAUSES OF ACTION, LIABILITIES, INCLUDING LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THIS PROMOTION OR IN ANY PROMOTION RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, FIRE, FLOOD, EARTHQUAKE OR OTHER CASUALTY, TERRORISM, WAR, INSURRECTION, RIOT, CIVIL DISORDER, UNREST OR DISTURBANCE, MARTIAL LAW OR OTHER GOVERNMENTAL RESTRICTIONS, INCLUDING RATIONING, PANDEMICS, EPIDEMICS, FAILURE OF FACILITIES OR SYSTEMS, ANY NATURAL OR MAN-MADE DISASTER OR OTHER CAUSE OF LIKE NATURE THAT IS BEYOND THE REASONABLE CONTROL OF THE RELEASED PARTIES (COLLECTIVELY, “FORCE MAJEURE EVENTS”).

BY PARTICIPATING IN THIS PROMOTION, ENTRANTS AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY THE LAW OF THE RELEVANT ELIGIBILITY AREA, THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR, AND HEREBY WAIVES ANY AND ALL RIGHT TO, ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE/SOCIAL ACCOUNT ASSOCIATED WITH THIS PROMOTION OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY SUCH SITE.

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS PROMOTION, INCLUDING THE PRIZES, IS PROVIDED "AS IS" AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. Publicity: EXCEPT WHERE PROHIBITED BY LAW, WINNER GRANTS TO SPONSOR AND ADMINISTRATOR (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR AND/OR ADMINISTRATOR), AND THOSE ACTING PURSUANT TO THEIR AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, WINNER'S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, ENTRY, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES SOLELY IN CONNECTION WITH THIS PROMOTION (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON THE INTERNET OR ON TELEVISION, NEWSPAPER OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION. ENTRANTS AGREE THAT SPONSOR SHALL OWN THE ENTRIES, WHICH WILL NOT BE ACKNOWLEDGED OR RETURNED.

10. Disputes: Except where prohibited by law, Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Hawaii or the appropriate state court located in Hawaii; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (c) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Hawaii, without giving effect to any choice of law or conflict of law rules (whether of the State of Hawaii or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Hawaii. 

11. Conflicts; Severability: In the event of any conflict with any Promotion details contained in these Official Rules and Promotion details contained in any other promotion materials (including but not limited to point of sale, television, radio and print advertising, promotional packaging, and other promotion media), the details of the Promotion as set forth in these Official Rules shall prevail. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed as if the invalid or illegal provision were not contained herein.

12. Privacy: Information collected from Entrants is subject to the Sponsor's Privacy Policy, which can be found at the following URL: www.hawaiianairlines.com/legal/privacy-policy, and may also be subject to the Administrator’s Privacy Policy, which can be found at the following URL: https://dja.com/privacy-policy/. The country, state, or province in which you live may require the Sponsor to delete your personal data upon written request from you, which the Sponsor will be bound to honor. However, you will be disqualified if your personal data is withdrawn or deleted prior to the determination of the Prize winner(s) and fulfillment of the Prize(s). This is not a penalty – it is recognition that in doing so the Sponsor’s and/or Administrator’s ability to administer the Sweepstakes is removed as to a person withdrawing their permission for Released Parties to use their personal data or asking that their personal data be deleted prior to the determination of the Prize winner(s) and fulfillment of the Prize(s).
